On July 30, 2014, the New Hampshire Department of Education (NHDOE) issued Memo #2 relative to “Guidance for Written notification of Parental Rights regarding use of public benefits or insurance.” The guidance is pertinent to Ed 1120.08 relative to the requirement that a school district send an annual notification of parental rights when parents are being asked to provide a one-time consent for Medicaid reimbursement purposes. This memo is a follow up to a memo provided by the NHDOE on May 28, 2014 whereby school districts were informed that a onetime parental consent for billing Medicaid is now allowable under the NH Special Education regulations.
We have posted the July 30, 2014 memo and model annual notification form here. As you know, we also previously posted the federal model notice. We would suggest that you consider the “optional” annual notice that the NHDOE has provided moving forward. This model notice not only contains all of the required elements under the federal regulations, but also all of the requirements of the recently amended NH Special Education Regulations.
